vPlan, a trademark of Most Wanted Software BV, a company registered in the Netherlands with registered KVK number 64674681, located at Hogepad 83, 7462 TB Rijssen, The Netherlands, together with its subsidiaries, divisions and affiliates ("vPlan"), understands the importance of protecting your privacy when you use our website. This Privacy Policy tells you about the information vPlan may collect on its websites and applications, how the information is used, and how you can access certain information we may collect.
If you, as a visitor or Buyer, choose to register and/or provide information to vPlan or the Website or Web Application, you consent to the use of such information in accordance with this Privacy Policy.

1. Collecting Personal Information through the Website. You may access many areas of our Website without submitting personally identifiable information. You may voluntarily choose to provide vPlan with personally identifiable information by filling out forms, sending emails or other means that may be provided from time to time on the Site. The personally identifiable information we would collect from you if you choose to do so generally includes your name and title, email address, mailing address, telephone, and information about your business. In addition to the information you voluntarily provide, vPlan may, at its option, collect additional information about you from third-party sources. Personal information collected by vPlan will be reasonably necessary to fulfil your requests and provide the most relevant, targeted offers and information from vPlan. All such information collected will be referred to herein as "Personal Data."
In addition, vPlan monitors incoming and outgoing site traffic data to diagnose problems with its servers and administer its site. vPlan also uses this data to compile broad demographic information about its visitors, customers and partners generally.
The following is a list of examples where you may choose to specifically and voluntarily submit personal information to vPlan through this site, which vPlan may use for any purpose indicated at the time of your submission:
- Request a copy of vPlan's publications, such as whitepaper(s);
- Register for access to certain areas of the site, such as the support desk, community and Web Application(s);
- Request for access to demos;
- Contact us for more information about products, services, events and programs or to submit questions or comments to vPlan;
- Subscribe to newsletters, information, alerts, offers and other communications;
- Submit a resume or application for possible employment with vPlan;
- Participate in surveys, quizzes, promotions or contests available on the Website from time to time;
- Register for attendance or sponsorship at events, webinars and conferences.
vPlan uses personal information submitted through the Website to provide clients, partners, customer and partner prospects and other contacts with a way to communicate with our team. vPlan collects personal information from you to establish and maintain relationships and to better serve you. If necessary, vPlan may also use the personal data separately or in combination with pre-existing information.
By voluntarily submitting your personal information, you consent to the collection and use of your personal information as described in this Privacy Policy. In some circumstances, vPlan may share personal information you voluntarily provide with trusted business partners. We will only use such third-party business partners to provide services to us or on our behalf, and they are prohibited from using that information for any other purpose.
Personal data collected on this site may be stored and processed in any country where vPlan (or its affiliates, subsidiaries and divisions and their respective business partners and suppliers) maintain facilities. This may include transfers to countries without data protection rules similar to those in your country of residence. You acknowledge and agree that by providing personal data to vPlan through this site, you consent to the transfer of such personal data across international boundaries as necessary to process your requests.
2. Collecting Personal Data through the Web Application. You may access the Web Application. You may voluntarily choose to register identifiable personal data within vPlan. A summary of personal information can be found here. All such collected information will be referred to herein as "Personal Data".
3. Processing of Personal Data. The Customer has a vPlan Agreement with vPlan which means that, among other things, we process personal data for and on behalf of you. According to the General Data Protection Regulation (GDPR), we must then enter into a 'processor agreement'. Because vPlan provides the Web Application and vPlan Service(s) by default, the 'processor agreement' is included in this Privacy Policy, as part of the vPlan Terms of Use. Herein, vPlan is the 'processor' and the Customer is the 'processor responsible'. Both parties must comply with the GDPR. The definitions that vPlan uses for this purpose are in line with the GDPR. vPlan only processes personal data on behalf of the Customer and for the purpose of implementing the vPlan Agreement.
Our processing consists of making available the Web Application containing available the data entered and generated by the Customer. We will not add, modify or remove any data without written instruction from the Customer. The instruction can be given by the Customer via our support.
Within the Web Application, the Customer may record various types of personal data. The Customer is responsible for assessing whether the purpose and nature of the processing is appropriate to the vPlan Service(s).
The Customer is solely responsible for the personal data entered, including the personal data of the person(s) concerned. Thus, any personal data transmitted to us is at the data subject's own risk. vPlan will never respond to requests from data subject(s) and always refer to the responsible party. If the data subject exercises her rights under the GDPR or other applicable laws and regulations for the processing of personal data, vPlan will always assist if it is possible within the Web Application so that the Customer can comply with legal obligations. To ensure the security of personal data, the Customer must provide sufficient proof of their identity at the time of such request before any personal data is made available by vPlan.
Once vPlan receives personal information, vPlan makes every effort to protect the confidentiality of that information in accordance with this Privacy Policy.
4. Protection of Personal Information. vPlan makes substantial efforts to protect the confidentiality of the personal data, preferences and other information it has collected and will never knowingly provide access to this information to anyone outside of vPlan other than as described herein. vPlan has made a substantial investment in its server, database, backup and firewall technologies to protect the information assets of the vPlan network, including the confidentiality of personal information collected through this site. System administrators of vPlan have full access to personal data for implementing patches, and hotfixes, managing backups and moving, and deleting data within the Web Application. Our Consultants, Support staff and other employees have access to your data only after your explicit consent. You can give this permission via the Web Application. vPlan processes Web Application data in data centers of our sub-processor Previder. These data centers are located exclusively in the Netherlands (Hengelo, OV) and are subject to Dutch laws and regulations. They comply with strict Dutch and European legislation for logical and physical access security and continuity. View the certificates of Previder here. vPlan also has other sub-processors. We do not allow our subprocessors to use the personal information we share with them for their marketing purposes or for any other purpose other than in connection with the services they provide to us. Due to the existing legal, regulatory and security environment, vPlan may be required under certain circumstances to disclose aggregate level or personally identifiable information submitted to vPlan through the Website or Web Application. vPlan will use reasonable efforts to limit such disclosures to one of the following circumstances:
- where vPlan believes in good faith that it is required in response to a subpoena or other legal process;
- where reasonably required to do so to maintain, update or otherwise implement vPlan's data security measures, equipment, technical operations and the like;
- where reasonably necessary to identify, contact or bring legal action to preserve or enforce the rights ofPlan, including but not limited to the enforcement of the Terms for this Site;
- protect and defend the rights or property ofPlan;
- in urgent circumstances to protect the personal safety of the public or users of the vPlan products, services and the Site.
In addition, vPlan may also disclose personal data in connection with the sale, assignment or other transfer of all or part of the vPlan business, or as part of a security audit.
To the extent required by applicable law or regulation, auditors (internal or external) of the Customer or hired by the regulator may conduct audits to verify vPlan's compliance with the terms and conditions outlined in the vPlan Agreement and this Privacy Policy. vPlan will notify you as soon as possible of any such audit unless prohibited.
The Purchaser must also do its part to protect your information. Your vPlan username and any password (if provided or executed) are confidential and we recommend that you not disclose them to anyone. Unfortunately, due to the nature of the Internet as a public transmission network, neither vPlan's network nor data transmission over the Internet can be guaranteed to be 100% secure. Therefore, while we strive to protect personal information transmitted to us by you, vPlan cannot ensure the security of such information.
5. Data breach notification requirement. The GDPR requires notification of any data breaches to the Authority for the Protection of Personal Data (AP) by the data controller. Therefore, vPlan itself does not make any notifications to the AP. Of course, we inform the Customer in a timely and complete manner about relevant incidents. As the data controller, this enables the Customer, to comply with the legal obligation.
We request that if the Customer makes a report to the AP and/or data subjects about a data breach at vPlan, the Customer informs us. We can then take appropriate actions more quickly.
To determine a breach related to personal data, we use the GDPR and the policy rules on mandatory data breach notification as guidance. When vPlan have a security incident or data breach, vPlan will notify the Customer as soon as possible. According to the GDPR, a security breach must be reported 'without delay'. According to the AP, this is without undue delay and, if possible, no later than 72 hours after discovery by the responsible party. In the event of a security incident, vPlan will inform the Customer as soon as possible, but no later than 48 hours after discovery. The Customer itself must assess whether the security incident falls under the term 'data breach' and whether a notification to the AP is required. After the Customer has been notified by vPlan, the Customer has 72 hours to do so. Initially, vPlan will inform the contact person of the subscription. vPlan always tries to provide all information immediately for a possible notification to the AP and/or data subject(s).
vPlan informs the Customer about the progress and the measures taken. Agreements on this are made with the contact person of the subscription. vPlan registers all security incidents and acts according to a fixed procedure.
6. Cookies on Website. If you view or download information, we may track your visit through the use of "cookies." Cookies are pieces of information that a website transfers to a person's hard drive for archival purposes. The use of cookies is an industry-standard and you will find cookies on most major websites. Cookies help vPlan tailor information to your preferences and to see which parts of the website are most visited. vPlan never uses cookies to retrieve information from your computer that was not originally sent in a cookie. Most browsers are initially set up to accept cookies. If you wish, you can change your browser settings to refuse cookies. However, if you do so, you may not be able to fully use the Site.
7. Web Beacons on Websites. Pages on this site may contain electronic images called web beacons, sometimes called single-pixel gifs or clear gifs. Web beacons may be used to deliver cookies throughout our site to track the number of users and track site activity.
8. Links to other websites. This Site may contain links to websites that are owned and operated by third parties and do not operate in accordance with this Privacy Policy. When you link to other websites through this Site, this Privacy Policy and our privacy practices no longer apply. We encourage you to read the privacy statements of each website before disclosing personally identifiable information. vPlan is not responsible for the privacy practices of such third party websites. 9. Choices regarding the use of personal data. If you voluntarily provide your personal information to vPlan, vPlan will use your personal information in accordance with this Privacy Policy. If at any time you decide that you do not want to continue to receive electronic communications, you may opt out or opt-in from receiving such communications by following a link in any such communication to the preferred site, or if not specified therein, by emailing or contacting us using the contact information in the "Contact Us" section of this Privacy Policy.
10. Data Retention. The personal data you provide to vPlan will be retained only as long as necessary for the purposes for which it was collected or as required by law. Retention of your personal data allows vPlan to continue to provide you with uninterrupted personalized services. 10. Changes to Privacy Policy. vPlan reserves the right to change this policy at any time and without notice to you. Your continued use of the Site following the posting of changes to these terms will constitute your acceptance of those changes. vPlan will take reasonable steps to notify you if there is a material change in our privacy practices concerning the use of the information you have provided to vPlan. vPlan will prominently post those changes to our Privacy Policy. vPlan will also post a notice on the home page of its Site that the Privacy Policy has changed and will include a link to the Privacy Policy.
